Terms & Conditions

1. Scope

The following terms and conditions apply to all orders placed through our online shop by consumers and entrepreneurs.

A consumer is any natural person entering into a legal transaction for purposes that are predominantly attributable neither to his commercial nor to his self-employed professional activity. An entrepreneur is a natural or legal person or a company with legal capacity that acts when a legal act is concluded in the exercise of his commercial or self-employed professional activity.

The following applies to entrepreneurs: If the entrepreneur uses conflicting or additional general terms and conditions, their validity is disputed; they are only part of the agreement if we have expressly agreed to this.

2. Contractor, conclusion of the contract, recoff possibilities

The purchase agreement is concluded with Happy Lamps GmbH.

By placing the products in the online shop, we make a binding offer to conclude an agreement for these items. You can first place our products in the shopping basket without obligation and correct your entry at any time before sending your binding order by using the appropriate correction devices and in the ordering process. The contract comes into being when you accept the offer for the goods in the shopping basket by clicking the order button. 2. Immediately after sending the order, you will receive a confirmation by e-mail.

3. Language of the contract, storage of the contract text

The language or languages available for conclusion of the contract: German

We will save the text of the contract and send you the order details and our Terms and Conditions in text form. You can view the text of the contract in our customer login.

4. Delivery conditions

The shipping costs will be added to the listed product prices. More information about shipping costs can be found in the offers.

We only deliver by mail order. Unfortunately, it is not possible to pick up the goods yourself.

5. Payment

In our store you can choose from the following payment methods:

Advance payment
If you choose prepayment, we will send you our bank details in a separate email and deliver the goods after receiving the payment.

Credit card
You fill in your credit card information when placing your order. Your card will be charged immediately after placing the order.

SEPA domicilization
When you place your order, you give us a SEPA direct debit mandate. We will inform you at least one bank working day in advance about the date of the collection (so-called prenotification). A bank working day is every working day with the exception of Saturdays, national holidays and December 24 and 31 of each year. The account is debited before the goods are sent.

PayPal
To pay the invoice amount through the payment service provider PayPal (Europe) S.à r.l. Et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, identify with your access details and confirm the payment order. The payment transaction is executed by PayPal immediately after placing the order. You will receive further instructions in the ordering process.

Sofort by klarna
In order to pay the invoice amount through the payment service provider Sofort GmbH, Theresienhöhe 12, 80339 Munich, you must have activated an internet banking bank account, identify accordingly and confirm the payment order. Your account will be debited immediately after placing the order. You will receive further instructions in the ordering process.

Google Pay
In order to pay the invoice amount through the payment service provider Google Ireland Ltd., Gordon House, Barrow Street, Dublin 4, Ireland ("Google"), you must be registered with Google, have activated the Google Pay feature, identify you with your access details and confirm the payment order. The payment transaction is executed immediately after placing the order. You will receive further instructions in the ordering process.

Apple Pay
To pay the invoice amount through the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA ("Apple"), you must use the browser "Safari", be registered with Apple, have the Apple Pay feature activated, identify with your access information and confirm the payment order. The payment transaction is executed immediately after placing the order. You will receive further instructions in the ordering process.

Amazon Pay
For the invoice amount through the payment service provider Amazon Payments Europe S.C.A. 38 avenue J.F. Kennedy, L-1855 pay Luxembourg ("Amazon"), you must be registered with Amazon, identify with your access details and confirm the payment order. The payment transaction is executed within one bank working day after placing the order. A bank working day is every working day with the exception of Saturdays, national holidays and December 24 and 31 of each year. You will receive further information during the ordering process.

Klarna
In collaboration with the payment service provider Klarna Bank AB (publ.), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna"), we offer you the following payment options. Payment through Klarna is only possible for consumers. Unless otherwise specified below, the payment through Klarna requires a successful address and credit check and is made directly to Klarna. You can find more information at the appropriate payment option and in the ordering process.

Purchase on account through Klarna
The invoice amount is due 14 days after the shipment of the goods and receipt of the invoice.

Klarna Credit Card
You enter your credit card information during the ordering process. Your card will be charged by Klarna immediately after the order. No address and creditworthiness check takes place.

Buy on installment via Klarna
You can pay the invoice amount in monthly instalments of at least 1/24 of the total amount. The minimum term is 6.95 euros.

Direct Debit Klarna
You give Klarna a SEPA direct debit mandate. Klarna informs you about the date of the collection (so-called prenotification). The account is debited after the goods are sent.

6. Right of withdrawal

Consumers are entitled to the legal right of withdrawal as described in the cancellation conditions. Entrepreneurs do not receive a voluntary right of withdrawal.

7. Property reservation

The goods remain our property until full payment has taken place.

In addition, the following applies to entrepreneurs: We reserve the ownership of the goods until all claims from an ongoing business relationship have been fully paid. You may resell the goods subject to a retention of title in the ordinary course of business; you bear all claims from this resale-regardless of any combination or mixing of the goods subject to a retention of title with a new item-in the amount of the invoice to us in advance and we accept this transfer. You remain authorized to collect the receivables, but we can also collect your own claims as long as you fail to meet your payment obligations. We will release the securities that we receive at your request, insofar as the recoverable amount of the securities exceeds the value of the outstanding claims by more than 10%.

8. Transport damage

For consumers, if goods are delivered with obvious transport damage, please contact the delivery company as soon as possible and contact us immediately. The failure to file a complaint or to contact us does not affect your statutory claims and their enforcement, in particular your guarantee rights. However, they help us to assert our own claims against the carrier or the transport insurance.

For business owners, the risk of accidental loss and accidental deterioration shall pass to you as soon as we have delivered the item to the forwarder, the carrier or the person or institution otherwise designated for the shipment.

9. Guarantee and safeguards

Validity of legal liability for defects

Unless explicitly agreed otherwise below, legal liability applies for defects.
The following restrictions and shortened terms do not apply to claims based on damages caused by us, our legal representatives or deputy agents

In case of injury to life, body or health
In the case of intentional or grossly negligent duty and in the case of deceit
In the event of a breach of essential contractual obligations, the fulfillment of which is a condition for the proper performance of the contract and the compliance of which the contract partner may regularly rely (cardinal obligations)
Under a guarantee commitment, if agreed, or
Insofar as the scope of the Product Liability Act is opened.
Restrictions on consumers

The following applies to the purchase of used goods by consumers: if the defect occurs after the expiry of one year after the delivery of the goods, the claims due to defects are excluded. Flaws that occur within one year of the delivery of the goods can be claimed within the statutory limitation period of two years after the delivery of the goods.

Restrictions towards entrepreneurs

With regard to business owners, only our own specifications and the product descriptions of the manufacturer included in the contract are subject to agreement on the quality of the goods; we do not accept liability for public statements by the manufacturer or other advertisements. For entrepreneurs, the limitation period for claims due to defects in newly manufactured goods is one year from the risk transfer. When selling used goods, any guarantee is excluded. The legal limitation periods for the right of recourse according to § 445a BGB shall be without prejudice.

Requirements concerning traders

Merchants are subject to the investigation and notification obligation regulated in § 377 HGB (German Commercial Code). If you omit the notification regulated therein, the goods will be deemed to have been approved, unless the defect was not recognizable during the inspection. This does not apply if we have deceitfully concealed a defect.

10. Liability

For claims based on damages caused by us, our legal representatives or deputy agents, we are always liable without limit

In case of injury to life, body or health,
In the case of intentional or grossly negligent duty,
In the case of guarantee promises, where agreed, or
Insofar as the scope of the Product Liability Law is opened.
In the event of a breach of essential contractual obligations, the fulfillment of which is a condition for the proper performance of the agreement and the compliance of which the contract partner may regularly rely (cardinal obligations), through minor negligence of us, our legal representatives or alternates, The amount of liability is limited to the damage foreseeable at the conclusion of the agreement, the action of which is typically to be expected.
Otherwise, claims for damages are excluded.

11. Dispute Resolution

The European Commission offers an online dispute resolution (OS) platform, which you can find here. We are not obliged or willing to participate in a dispute process before a consumer arbitration committee.

12. Final provisions

If you are an entrepreneur, German law applies to the exclusion of the UN Convention on International Purchase Agreements relating to movable property.

If you are a merchant within the meaning of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction is for all disputes arising from contractual relations between you and our seat.
